Commons registration forms and fees

What form to fill in, how much to pay, and how to pay, for different applications under the Commons Act 2006.

Every application under Part 1 of the Commons Act 2006 must be made in writing on a form provided by the Secretary of State for an application of that type, signed by every applicant or their representative and posted to:

If you want to amend the rights section of the register, we will need a separate application for each entry to be amended, the exception being when the same set of rights is exercisable over multiple commons.

How to pay

Some applications have a fee, these are stated in each form.

We accept payments by cheque made out to Cumberland Council. If you prefer to pay by debit or credit card, or BACS, you can request to be invoiced instead.

Creating a new right of common (CA1)

Use the CA1 form if you want to:

  • create a right of common resulting in the registration of new common land - no fee
  • create a right of common over existing common land - fee is £272.80

Changing a right of common (CA2)

Use the CA2 form if you want to:

  • variation a right of common - fee is £272.80
  • variation a right of common resulting in the registration of new common land - no fee

Sharing a right of common (CA3)

Use the CA3 form if you want to apportion a right of common. This costs £272.80

Attaching a right of common to a property (CA4)

Use the CA4 form if you want to attach a right of common to a property. There is no fee.

Reallocating of a right of common (CA5)

Use the CA5 form if you want to re-allocate attached rights. There is a fee of £272.80.

Transfer of a right of common in gross (CA6)

Use the CA6 form if you want to transfer a right of common in gross. There is a fee of £110.70

Surrender and extinguish a right of common (CA7)

Use the CA7 form if you want to surrender and extinguish a right of common. There is a fee of £221.10.

Statutory disposition (CA8)

Use the CA8 form if you want to extinguish or transfer common land or town or village green and any rights of common on the land where it has been acquired by a ‘relevant instrument’. Including the exchange of land for land subject to a statutory disposition 

There is a fee of £409.20.

Register a town or village green (CA9)

Register a town or village green

This relates to section 15 (1 and 8) of the Commons Act 2006.

Correcting a mistake in the register (CA10)

Use form CA10 and send payment for the amount indicated if you want to:

  • request a correction, for the purpose of section 19(2)(a) of the 2006 Act (of a mistake made by the registration authority) and 19 (2)(c) removing a duplicate entry from the register - no fee
  • request a correction, for a purpose described in section 19(2)(b), or (e) - fee of £272.80
  • request a correction, for a purpose described in section 19(2)(d) - fee of £47.30

Severance of a right of common by transfer to a public body (CA11)

Use the CA11 form if you want to severance by transfer to public bodies. There's a fee of £220.

Severance of a right of common by order (CA12)

Use the CA12 form if you want to severance authorised by order. There's a fee of £220.

Non-registration or mistaken registration under the Commons Registration Act 1965 (CA13)

Fill out form CA13 and send payment for the amount indicated for:

  • non-registration of common land or town or village green - no fee
  • waste land of a manor not registered as common land - no fee
  • a town or village green wrongly registered as common land - no fee
  • deregistration of certain land registered as common land or as a town or village green - there's a fee of £1355

Registering historic events (CA14)

Fill out form CA14 and send payment for the amount indicated if you want to:

  • creation of a right of common - the fee is £519
  • surrender or extinguishment of a right of common - the fee is £273
  • vary a right of common - the fee is £487
  • apportion a right of common to facilitate any other purpose - the fee is £432
  • request a severance of a right of common - the fee is £273
  • transfer a right in gross - the fee is £273
  • request a statutory disposition, including the exchange of land for land subject to a statutory disposition - the fee is £487

Declaring your entitlement to a right of common (CA15)

Fill out form CA15 and send payment for the amount indicated if you want to declare entitlement to exercise a right of common - the fee is £72.
